| Description | In this paper, the author analyzes the emergence of Environmental International Law as an autonomous branch of the International Law within the framework of International Justice Court’s jurisprudence (IJC). Thus, he delves deep into the environmental damage derived from the use of nuclear weapons and the state customary obligations in environmental law regarding to other States’ territories. Finally, he examines a recent IJC jurisprudence that introduces new legal norms in connection with the frontier damage. | en-US |
| Description | En el presente artículo, el autor analiza el surgimiento del Derecho Internacional Ambiental como una rama autónoma del Derecho Internacional en el marco de la jurisprudencia de la Corte Internacional de Justicia (CIJ). Así, profundiza respecto a los daños ambientales derivados del uso de armas nucleares y las obligaciones consuetudinarias estatales en materia ambiental con respecto a los territorios del resto de Estados. Finalmente, desarrolla reciente jurisprudencia de la CIJ que incorpora nuevas normas jurídicas en cuanto al daño transfronterizo. | es-ES |
