DescriptionThe requirement of the bankruptcy ineffectiveness of acts performed under the rules of the period of suspicion of a debtor company are not satisfied with just verify that it was an act that is not included in the description of its corporate purpose, nor with verification that it is indeed included to conclude that the requirement is not met. For this reason, article 11 of the Peruvian Corporations law should be apply, which is included in the social object acts related to it that contribute to the accomplishment of its purposes. This allows that they may be part of the social activities not directly linked to the productive or commercial activities.en-US
DescriptionEl requisito de la ineficacia concursal de los actos realizados bajo las reglas del periodo de sospecha de una sociedad deudora no se satisface con solo verificar que se trató de un acto no incluido en la descripción de su objeto social, ni tampoco con la verificación de que sí está incluido para concluir que el requisito no se cumple. Por ese motivo, se debe aplicar el artículo 11 de la Ley General de Sociedades peruana, que da por incluidos en el objeto social los actos relacionados a él que coadyuvan a la realización de sus fines. Ello permite que puedan ser parte del objeto social actividades no vinculadas directamente a las actividades productivas o comerciales.es-ES
