DescriptionWithin Mexican Labor Law, which began with the best social intentions, it is generating a conservative evolution, often based on greedy interpretations of the and in other cases on the following of foreign model. The lack of respect for Trade Union Freedom and Autonomy is a main topic. The fact that at Federal Level, the Ministry of Labor and Social Security is the one in charge of trade unions registration, determines that all excuses in the world are used in order to refuse the registration if the union concerned is not part of the group allowed by the government. This, of course, violates the Convention 87 of ILO on freedom of association that Mexico signed. And that administrative action is reflected in the conduct of the Federal Conciliation and Arbitration Board, clearly a branch of the Ministry which reserves the right to recognize the union leaders who do not have registration. Registrations should be removed and be replaced to mere documentation deposits, properly publicized so that if someone is entitled to do so, might be able to challenge them by the courts.en-US
DescriptionEn el derecho mexicano del trabajo, que se inició con los mejores propósitos sociales, se está produciendo una evolución conservadora, muchas veces con base en interpretaciones interesadas de sus disposiciones y, en otros casos, siguiendo modelos extranjeros. Es tema fundamental la falta de respeto por la libertad y la autonomía sindicales. El hecho de que en materia federal sea la Secretaría del Trabajo y Previsión Social la encargada del registro de los sindicatos determina que con todos los pretextos del mundo se nieguen los registros y las tomas de nota, si el sindicato interesado no forma parte del grupo de los consentidos por el gobierno. Con ello, por supuesto, se viola el Convenio 87 de Libertad Sindical de la OIT que México ha suscrito. Y esa medida administrativa se refleja en la conducta de la Junta Federal de Conciliación y Arbitraje, sucursal evidente de la Secretaría, que se reserva reconocer a los dirigentes sindicales que no tienen toma de nota. Hay que suprimir los registros y tomas de nota y sustituirlos por simples depósitos de la documentación, debidamente publicitada, para que si alguien legitimado para hacerlo lo desea, pueda impugnarlos por la vía jurisdiccional.es-ES
