DescriptionIn this article, the author reflects on the legal aspects of the current Constitutional Treaty of the European Union. He analyses the efforts of a civil society developed through a draft European Constitution, which is becoming a fertile testing ground for all contemporary constitutionalism. This Constitution is essential not only because it introduces limits and links to the European decision-making bodies from which much of European law currently comes, but also because it contains rights and guarantees that are at risk of being undermined.en-US
DescriptionEn el presente artículo, el autor realiza una reflexión sobre los aspectos jurídicos que presenta el actual Tratado Constitucional de la Unión Europea. Se analiza el esfuerzo de una sociedad civil desarrollada a través de un proyecto de Constitución europea, mismo que se está convirtiendo en un fértil campo de pruebas para todo el constitucionalismo contemporáneo. Esta Constitución es esencial no sólo porque introduce límites y vínculos a los órganos decisionales europeos de los que proviene actualmente gran parte del derecho europeo, sino también porque contiene derechos y garantías que corren el riesgo de venir a menos.es-ES
