DescriptionLa crisis sanitaria mundial ha propiciado un fecundo debate iusfilosófico en lo referente a la protección de los derechos humanos. El nuevo escenario exige respuestas nuevas por parte de la filosofía del derecho. En este trabajo se somete a crítica la teoría del garantismo constitucional de Luigi Ferrajoli, cuestionándose su idoneidad como marco de referencia para afrontar los mencionados desafíos. La crítica se centra en la concepción ferrajoliana de la democracia y en su proyección cosmopolita. Se argumentará que la extensión del constitucionalismo más allá del Estado debe realizarse a partir de un cosmopolitismo gradual y realista.es-ES
DescriptionThe global health crisis has given rise a fertile legal-philosophical debate on the protection of human rights. The new scenario calls for new responses from legal philosophy. This paper criticises Luigi Ferrajoli's theory of constitutional guarantee, questioning its suitability as a framework for addressing these challenges. The critique focuses on Ferrajoli's conception of democracy and its cosmopolitan projection. It will be argued that the extension of constitutionalism beyond the state must be based on a gradual and realistic cosmopolitanism.en-US
