DescriptionThe contemporary debate about the rule of law assumes an apparently inevitable dilemma: either we conceive this ideal as merely instrumental and therefore independent of any substantive political morality, or we devise it as a non-instrumental ideal and, thereupon, as tied to a specific theory of justice. This paper aims to offer an alternative, which is called the “formal-constitutional conception”, where legality appears as an independent and, simultaneously, intrinsically valuable political ideal. On the path of Lon Fuller, this conception consists of a number of procedural requirements that do not determine the content of the legal norms, but serve as a moral tribunal in which the positive law is accountable.en-US
DescriptionEl debate contemporáneo sobre el imperio de la Ley encierra un dilema aparentemente inexorable: o bien concebimos dicho ideal político como meramente instrumental y, por tanto, independiente de cualquier moralidad política sustantiva, o bien lo pensamos como un ideal no instrumental y, por tanto, vinculado a una determinada teoría de la justicia. En este trabajo se presenta una alternativa, a la que se denomina “concepción formal-constitucional” de la legalidad, en la que ésta aparece como un ideal político independiente y, al mismo tiempo, intrínsecamente valioso. En la senda de Lon Fuller, esta concepción consiste en un conjunto de requisitos procedimentales que no determinan el contenido de las normas jurídicas, pero que sirven de tribunal moral ante el que debe rendir cuentas el Derecho positivo.es-ES
