DescriptionThirty-five years after its enactment, there is still not academic or judicial consensus regarding the model of Church and State relationship that the Spanish Constitution draws, despite having been defined by the Constitutional Court, although not to the liking of everybody. The reason of this controversy lies in the Agreements with the Holy See currently in force, which, as the author intends to demonstrate, contain, from a material point of view, important violations of the secularism principle, violations that cannot be remedied without the consent of the Catholic Church since, from a formal point of view, the Agreements equate with international treaties. In the face of this reality, some future solutions to overcome the current impasse and make the system fit into the constitutional framework are proposed.en-US
DescriptionTreinta y cinco años después de su promulgación, aún no existe consenso doctrinal ni judicial sobre el modelo de relaciones Iglesia-Estado que la Constitución española dibuja, aún cuando sí haya sido definido por el Tribunal Constitucional, claro que no dando gusto a todo el mundo. En la causa de ese desacuerdo están los vigentes Acuerdos con la Santa Sede, que, como la autora trata de evidenciar, acogen, desde un punto de vista material, importantes vulneraciones del principio de laicidad, vulneraciones además imposibles de subsanar sin el beneplácito de la Iglesia porque, desde un punto de vista formal, los acuerdos se equiparan a los tratados internacionales. Ante esta realidad, se proponen soluciones de futuro que superen la actual situación de impasse/punto muerto/callejón sin salida y adecúen el sistema al marco constitucional.      es-ES
