DescriptionThe right to education is a fundamental right and due to the horizontal effect of those rights, its compliance can be demanded to other individuals, including educational institutions. School coexistence is part of the right to education and bullying and school violence are flagrant attacks against such coexistence. Consequently, bullying and school violence constitute attacks against the right to education. Such an attack constitutes, in turn, a breach of contract and a crime or tort. Therefore, both, the contractual and non-contractual liability regime would be applicable. In view of this, this would be a borderline case of concurrence of liabilities.en-US
DescriptionEl derecho a la educación es un derecho fundamental y por el efecto horizontal de aquellos, su observancia puede ser exigida a otros particulares, entre ellos, instituciones educativas. La convivencia escolar forma parte del derecho a la educación y el bullying y la violencia escolar constituyen atentados flagrantes contra dicha convivencia. Consecuencialmente, el bullying y la violencia escolar constituyen atentados contra el derecho a la educación. Este atentado implica, a su vez, un incumplimiento contractual y un delito o cuasidelito civil. Por tanto, le serían aplicables tanto el régimen contractual como extracontractual de responsabilidad. Atendido aquello, este sería un caso fronterizo de concurrencia de responsabilidades.es-ES
