DescriptionThe principle of biological truth is established as a founding principle of the filiation Chilean system. However, nowadays the preponderance of the coincidence between legal filiation and genetic correspondence between father and son is being questioned. This article aims to reflecton this topic regarding the figure of recognition. Exploring, in particular, what the jurisprudential answer has been regarding the possibility to cancel this act when the one who recognizes paternity alleges that he has incurred in an error discovering, afterward, that the child is not biologically his. Finally, a critical balance is presented, proposing to understand in a restricted manner the scope of the annulment action based on a recognition error, which will have to fulfill certain requirements to prosper. In the instances in which the action is denied, the filiation will stand, despite not being based on biological truth, so that recognition operates as an exception to this principle. This is justified by the purpose sought by the institution, which determines that genetic correspondence is not, in all cases, a quality of the son that possesses relevance to vitiate consent.en-US
DescriptionEl principio de verdad biológica se instaura como principio fundante del sistema filiativo chileno. Sin embargo, hoy se comienza a cuestionar la preponderancia de la coincidencia entre la filiación legal y la correspondencia genética entre padre e hijo. En este trabajo se pretende reflexionar acerca de este tópico, a propósito de la figura del reconocimiento, en particular, explorando cuál ha sido la respuesta jurisprudencial ante la posibilidad de anular este acto cuando el reconociente alega que ha incurrido en un error al descubrir, con posterioridad, que el hijo no es biológicamente suyo. Por último, se presenta un balance crítico que propone entender de manera restringida el ámbito de aplicación de la acción de nulidad del reconocimiento por error, debiendo cumplir ciertos requisitos para prosperar. En los casos en que la acción sea rechazada, se mantendrá la filiación a pesar de no ampararse en la verdad biológica, por lo que el reconocimiento operará como una excepción a este principio. Ello se justifica en la finalidad perseguida por la institución, la cual determina que la correspondencia genética no es, en todos los casos, una cualidad personal del hijo que tenga la entidad para viciar el consentimiento.es-ES
