DescriptionThis paper analyzes the sentence pronounced by the Supreme Court, dated March 22, 2023, in case number 144.044-2020, titled “SQM Salar S.A. against the Chilean Treasury”, referring to the granting of a mining easement requested by the plaintiff with respect to twelve hectares, for fifty years. The Supreme Court, in a cassation ruling on the merits, annuls the final sentence handed down by the Antofagasta Court of Appeals and instead confirms the one pronounced in the first instance.en-US
DescriptionEn el presente trabajo se analiza la sentencia pronunciada por la Corte Suprema, con fecha 22 de marzo de 2023, en la causa rol n° 144.044-2020, caratulada SQM Salar S.A. en contra de Fisco de Chile, referida al otorgamiento de una servidumbre minera pedida por la actora respecto de doce hectáreas, por cincuenta años. La Corte Suprema, en fallo de casación en el fondo, anula la sentencia definitiva dictada por la Corte de Apelaciones de Antofagasta y en su reemplazo confirma la pronunciada en primera instancia.es-ES
