DescriptionA recent decision of the Supreme Court offers valuable guidelines regarding the way in which a notary public must comply with the instructions given by the parties at a sale to pay the price. The decision highlights the lack of leeway of the notary public in order to determine the scope of the instructions, as well as his or her inability to interfere in the risk allocation agreed by the parties. The Supreme Court also deepens in the legal nature of the instructions and applies to them the rules of the contract of mandate. The commentary critically reviews these subjects in view of the practical scope which the instructions fulfil.en-US
DescriptionUna reciente sentencia de la Corte Suprema ofrece valiosas directrices en relación con el modo en que los notarios deben cumplir con las instrucciones que les imparten las partes de la compraventa para efectos de pagar el precio. El fallo hace especial énfasis en la falta de discrecionalidad del notario para determinar el alcance de las instrucciones, así como en su imposibilidad de intervenir en la distribución de riesgos libremente acordada por las partes. La Corte Suprema profundiza, asimismo, en la naturaleza jurídica de las instrucciones, haciéndoles aplicable las reglas del mandato. El comentario analiza críticamente estas materias a la luz de los objetivos prácticos que las instrucciones están llamadas a cumplir.es-ES
