DescriptionCuban municipalities developed, in the last decades, without the express recognition of autonomy. This has resulted in the almost general forgetting of the possibility of issuing norms, creating a context with limitations to assume the projections of the 2019 Constitution of the Republic of Cuba in this regard. Hence the need to base the legal assumptions that must support the exercise of normative power in the current Cuban municipal design. To do this, the particularities present in the country are assessed in light of current legislation and, based on the deficiencies identified and supported by the doctrine, the aforementioned assumptions are argued. The first of these focuses on the aforementioned local power; the second to the establishment of the delimitations in its scope; and the third to propose guidelines for a regulation of the matter in a Municipal Law.en-US
DescriptionLas municipalidades cubanas se desarrollaron, en las últimas décadas, sin el expreso reconocimiento de la autonomía. Ello ha redundado en el olvido, casi generalizado, de la posibilidad de emitir normas, creando un contexto con limitaciones para asumir las proyecciones de la Constitución de la República de Cuba de 2019 en este sentido. De ahí la necesidad de fundamentar los presupuestos jurídicos que deben sustentar el ejercicio de la potestad normativa en el actual diseño municipal cubano. Para ello, se valoran las particularidades presentes en el país a la luz de la legislación vigente y, a partir de las deficiencias identificadas y con apoyo en la doctrina, se argumentan los referidos presupuestos. El primero de estos se enfoca al contenido del aludido poder local; el segundo al establecimiento de las delimitaciones en su alcance; y el tercero a proponer pautas para una regulación de la materia en una Ley de Municipios.es-ES
