DescriptionIn this paper we will analyze the principle of the division of powers in the economic emergency. We will study the origins of this principle and its characteristics in Argentina, and the institute of economic emergency. It is observed that during economic emergency, the Executive is the branch of government that has increased its powers, through the issuance of “decrees of need and urgency”, and the delegation of legislative powers. We conclude that although the constitutional reform of 1994 has sought to limit the exercise of such powers, in practice this goal has not been achieved. DescriptionEl trabajo tiene por objeto analizar el principio de la división de poderes en la emergencia económica. Se estudian los orígenes de este principio y sus características en la Argentina y el instituto de la emergencia económica. Se observa que durante las crisis económicas, el Poder Ejecutivo es el poder del Estado que más ha visto acrecentadas sus facultades a través del dictado de los decretos de necesidad y urgencia, y la delegación legislativa. Se concluye que a pesar de que la reforma constitucional de 1994 ha buscado limitar el ejercicio de tales atribuciones, en la práctica aquella finalidad no se ha cumplido, siendo necesario un control judicial más estricto al respecto.es-ES
