DescriptionWe present an analysis of case law developed by the Colombian Constitutional Court in the review of three proposed constitutional amendments, initiative gubernatorial, legislative and popular, promoted between 2002 and 2010 to constitutionally enshrine the figure of an immediate presidential reelection, for three consecutive terms. This figure favored the continuity in the government of Alvaro Uribe and his program of government: Democratic Security Policy (DSP), whose objective was to achieve peace through the declaration of war against the guerrilla group Revolutionary Armed forces of Colombia (FARC). Our purpose is to implement and bring out the three initiatives to describe the Colombian constitutional development, immersed in processes of political violence against the State and the State, and the balance that has served the Constitutional Court (Court) from a strong judicial activism.en-US
DescriptionPresentamos un análisis de los precedentes jurisprudenciales desarrollados por la Corte Constitucional colombiana en el proceso de revisión de tres proyectos de reforma constitucional, de iniciativa gubernativa, legislativa y popular, promovidos entre 2002 y 2010 orientados a la materialización del programa de gobierno del entonces presidente Álvaro Uribe Vélez, y a la consagración constitucional de la figura de reelección presidencial de manera inmediata, por tres períodos consecutivos. La reelección inmediata propiciaba la continuidad en el gobierno de Álvaro Uribe Vélez y su programa de gobierno: Política de Seguridad Democrática (PSD), cuyo objetivo fue alcanzar la paz mediante la declaratoria de guerra al grupo guerrillero Fuerzas Armadas Revolucionarias de Colombia (FARC). Nuestro propósito es instrumentalizar y poner en evidencia las tres iniciativas para describir el desarrollo constitucional colombiano, inmerso en procesos de violencia política contra el Estado y desde el Estado y, el equilibrio que ha ejercido la Corte Constitucional (Corte) desde un marcado garantismo judicial.es-ES
