DescriptionThe legal research of mexican budgetary judicial order did not have any development for more than 70 years because of the permanency of one political party in power. During that period the approval procedure of the Budget Disbursement, cornerstone of budgetary law, become a simple administrative procedure without any discussion among President and Parliament. At the end of twentieth century and beginning of the twenty first, political party in power changed and different problems related with public spending judicial order came up. The veto to the Federal Budget Disbursement is not irrelevant in this new situation. The article compares both positions about it, the one in favor of veto, assumed by our National Supreme Court, and the one that refuses this faculty to the president, which is the one that the author supports.en-US
DescriptionEl estudio del sistema jurídico presupuestario mexicano estuvo encapsulado por más de 70 años como consecuencia de la entronización en el poder de un solo partido político. Durante ese periodo, el procedimiento de aprobación del Presupuesto de Egresos, columna vertebral del Derecho Presupuestario, se convirtió en un simple trámite administrativo carente de desavenencias entre el Poder Ejecutivo y la Cámara de Diputados. A finales del siglo XX y principios del presente, México experimenta la alternancia en el poder y con ello emergen diferentes problemas que gravitan en torno a la ordenación jurídica del gasto público. El veto al Presupuesto de Egresos de la Federación no escapa a este nuevo escenario. En este artículo se confrontan las dos vertientes que existen al respecto, entre los que se decantan por la procedencia del veto, posición que asume nuestra Suprema Corte de Justicia de la Nación, y entre los que le niegan dicha facultad al Presidente de la República, con la cual, finalmente, el autor se identifica.es-ES
