DescriptionThe author makes an evolutionary analyze of 1994 constitutional reform to the Argentinian Constitution, especially about its legitimacy, principal ideas and the breach of such reform. The necessity law of that reform, the Convention regulation and the political pluralism of that Convention obtained the criticized legitimacy. Due to the principal's ideas, is important by its special content, the attenuation of the presidentialism with the Ministers Cabinet Head, 4 years period with one reelection and the limit to the necessity and urgent decrees, the expansion of municipalities authorities with the constitutional recognition of municipal autonomy and the new statute of Buenos Aires City which allows to designate its authorities and the popular election of the mayor district. It worries that legislation required to apply the constitutional reform have been sent just in a third part and that five provinces has not reformed its constitutional text to adopt the constitutional reform in municipal autonomy.en-US
DescriptionEl autor hace un trazo evolutivo de lo que ha acontecido con la reforma constitucional de 1994 a la Constitución argentina, especialmente sobre su legitimidad, las ideas principales y el incumplimiento de tal reforma. La ley de necesidad de la reforma, el reglamento de la Convención y el pluralismo político presente en dicha Convención, logró la legitimidad criticada. Entre las ideas principales, sobresalen por su especial contenido, la atenuación del presidencialismo con la figura de jefe de Gabinete de Ministros, período de 4 años con reelección y el límite a los decretos de necesidad o urgencias, el fortalecimiento de las autoridades municipales con el reconocimiento constitucional de la autonomía municipal, y el nuevo estatuto de la ciudad de Buenos Aires que le permite designar a sus autoridades y elegir popularmente al intendente de distrito. Preocupa que la legislación requerida para hacer aplicable la reforma constitucional ha sido expedida sólo en una tercera parte y que cinco provincias no hayan reformado su texto constitucional para adoptar la reforma constitucional en materia de autonomía municipal.es-ES
