DescriptionThis article deals with a subject of capital importance: is it possible to get to declare the patrimonial responsibility of the State-legislator as a result of laws that have been declared unconstitutional? and, more in particular, what would happen supposing that from the previous application of such Law a series of income in charge of the citizens has been derived? It is analyzed the nature of Sentences of Constitutional Court, making a difference between those having retrospective character and those having a prospective one, and regarding these last it is examined the doctrine applied by the Spanish Supreme Court according which in cases like these an indemnity declaration in favor of affected ones is due, every time the requirements concur totally to declare patrimonial responsibility of public entities.en-US
DescriptionEn este artículo se trata un tema de capital importancia: es posible llegar a declarar la responsabilidad patrimonial del Estado-legislador como consecuencia de leyes que hayan sido declaradas inconstitucionales, y concretamente, qué ocurre en el supuesto de que de la previa aplicación de tal ley se hayan derivado una serie de ingresos a cargo de los ciudadanos. Se analiza la naturaleza de las sentencias del Tribunal Constitucional, diferenciando entre las que tienen carácter retrospectivo de las que lo tienen prospectivo, y con relación a estas últimas se examina la doctrina aplicada por el Tribunal Supremo español, en el sentido de que en estos casos es procedente la declaración de indemnización a los afectados, toda vez que concurren plenamente los requisitos para decretar la responsabilidad patrimonial de los entes públicos.<ies-ES
