| Description | The amendment to the Argentinian National Constitution in 1994 regarding municipal matters has caused several debates in many counties -as in the case of Mendoza- in which their constitutions do not contemplate this autonomy. In this document, the author studies the evolution of municipal law in Argentina, making a comparative study of the municipality in the Argentinean provincial constitutional regime. She points out the differences and similarities regarding territory and population, organization of power, elections and duration of mandates, resources and popular participation among other topics. The author also analyzes the doctrinal opinions and the argentine judicial precedents that stand out in this matter, outlining a possible solution to this problem, especially in the case of Mendoza"s County. | en-US |
| Description | La reforma de la Constitución Nacional Argentina de 1994, en materia municipal, ha provocado debates en varias provincias -como el caso de Mendoza- en las que sus remotas constituciones no contemplan dicha autonomía. En el presente trabajo, la autora estudia la evolución del derecho municipal en Argentina, haciendo un estudio comparativo del municipio en el régimen constitucional provincial argentino, en donde señala las diferencias y semejanzas en materia de naturaleza jurídica, territorio y población, organización de poder, formas de elección y duración del mandato, recursos y participación popular y, entre otros temas, competencias municipales. Asimismo, la autora analiza las opiniones doctrinarias y los fallos jurisprudenciales nacionales argentinos que han sobresalido en esta materia para dar una posible vía de solución a este polémico tema, especialmente en el caso de la Provincia de Mendoza. | es-ES |
