DescriptionIn the authors" opinion, there are three "classic" principles which should govern the legal regulation of the religious phenomenon, i. e.: religious teachings, religious attendance on people in special situations "armed forces" and the civil effects of religious acts. To establish these principles they resort to verdicts returned by the Spanish Constitutional Tribunal, to the agreements between Spain and the Holy See and to others signed with various religious groups outside the Catholic Church. In summary, the article aims to show that the informative principles of ecclesiastical law and religious equality should always be realistically applied to practical matters.en-US
DescriptionEn opinión de los autores, tres son los principios "clásicos" que deben orientar la regulación jurídica del fenómeno religioso, a saber: la enseñanza religiosa, la asistencia religiosa a personas en situaciones especiales -fuerzas armadas-, y los efectos civiles de los actos religiosos. Para fundamentar estos principios acuden a sentencias del Tribunal Constitucional español, a los acuerdos entre España y la Santa Sede y a otros suscritos con diversas confesiones religiosas distintas a la católica. En resumidas cuentas, el artículo pretende mostrar que los principios informadores del derecho eclesiástico y la igualdad religiosa deben encontrar siempre una aplicación real en los asuntos prácticos.es-ES
