| Description | Within the current article, the author outlines a series of reflections of five topics that he names Dogmas of the Theory of the Constitution; these topics are: the principle of legality, the division of powers, the control of the constitutionality, the prevalence of domestic law over international law, and, the interpretation methods. These dogmas are barriers that are incorporated to the diverse juridical concepts since the initial scholar experience. Furthermore, the dogmas understand the legal reality only in one way (sense) causing the impoverishing and reduction of such reality because they do not take into account the big challenges of the present time such as globalization, and rights of the minorities. In this way, the author considers that the discussion of the revision of the mentioned dogmas is inevitable, because, while the national and international reality changes quickly, the legal mexican culture remains unaffected. | en-US |
| Description | El autor plantea una serie de reflexiones en torno a cinco temas a los que califica como dogmas de la teoría de la Constitución: el principio de legalidad, la división de poderes, el control de la constitucionalidad, el prevalecimiento del derecho interno sobre el externo y los métodos de interpretación. En su concepción, estos dogmas son barreras que desde la experiencia académica van incorporándose a los conceptos jurídicos, empobreciendo y reduciendo la realidad jurídica, al no tomar en cuenta los grandes retos de nuestro tiempo como la globalización y los derechos de las minorías, entre otros. Por tanto, el autor considera que es inevitable la discusión de la revisión de los mencionados dogmas, ya que mientras la realidad nacional e internacional cambia aceleradamente, la cultura jurídica mexicana permanece inalterada. | es-ES |
