DescriptionThe author puts forward the composition, competence, functions and performance of the Constitutional Court of the Ukraine, established in October 1996 and in operation as from April 1997. In his analysis, which covers both the binding faculties (decisions) and the non-binding faculties (opinions) of the Court, its limitations of competence, the forms of control and the no retroactivity principle of its decisions, the author extensively uses references to cases in which it has intervened and established a precedent. Of particular interest is a study of the doctrine of "political opportunity" elaborated by the Court, together with its refusal to fill-in legislative "black holes".en-US
DescriptionEl autor expone la integración, competencia, funciones y desempeño de la Corte Constitucional de Ucrania, establecida en octubre de 1996 y en funciones a partir de abril de 1997. En su análisis, que comprende tanto las facultades vinculatorias (decisiones) como las no vinculatorias (opiniones) de la Corte, los límites de su competencia, las formas de control y el principio de no retroactividad de sus decisiones, el autor utiliza extensivamente referencias a los casos en que se ha intervenido y sentado un precedente. Resulta especialmente interesante el análisis de la doctrina, elaborada por la Corte, de la "oportunidad política", así como su rechazo a completar las lagunas legislativas.es-ES
