| Description | This paper analyzes the effects of the bad faith incident regulated in article 169 A subsection 4 of Act 20.720. Based on a dogmatic analysis of the institution of the rejection of the discharge of the debt based on the prevention of abuse, considering the elements of the notion of abuse of the natural person, and a comparative analysis of the history of the law regarding the introduction of the rule in the Chilean legal system, the extent of the institution is determined and solutions are proposed to the problems of limitation of the relief interest of the debtor and legal uncertainty that the rule presents. | en-US |
| Description | Este trabajo analiza los efectos del incidente de mala fe regulado en el artículo 169 A inciso 4 de la Ley 20.720. A partir de un análisis dogmático de la institución del rechazo de la descarga de la deuda con fundamento en la prevención del abuso, en el que se consideran los elementos de la noción de abuso de la persona natural, junto a un examen comparado de la historia de la ley en torno a la introducción de la norma en el ordenamiento chileno, se determinan los alcances de la institución y se plantean soluciones a los problemas de limitación del interés de alivio del deudor y de incertidumbre jurídica que la norma presenta. | es-ES |
