DescriptionIn this work, we will analyze the regulation of the insolvency in the legislation of the Argentinean Republic. That is to say, we will study the celebrated and, at the same time, enigmatic, article 4° of the national Law of Bankruptcy N° 24.522. This rule is complemented by the articles 2.2 and 3.5 of the same law. It is very important to study this national legislation because it is applicable sine qua non in all those cases that Argentina has not celebrated international treaties about international insolvency. Keeping in mind that our country is only linked with a few countries through the Treaties of Montevideo, we notice that there are countless cases that are outside of the conventional regulation.en-US
DescriptionEn el presente trabajo analizaremos la regulación de la insolvencia en la legislación de la República Argentina. Es decir, estudiaremos principalmente el célebre y a la vez, enigmático, artículo 4° de la Ley nacional de Concursos y Quiebras N° 24.522. Dicha norma es complementada por los artículos 2° inciso 2° y 3° inciso 5° del mismo cuerpo legal. Es de suma importancia encarar el estudio de esta normativa ya que resulta aplicable sine qua non en todos aquellos casos en que la Argentina no ha celebrado tratados internacionales en la materia. Teniendo en cuenta que nuestro país sólo se encuentra vinculado con un puñado de países a través de los Tratados de Montevideo, advertimos que son innumerables los supuestos que quedan fuera del marco normativo convencional.es-ES
