DescriptionThe article attempts to show a brief overview of the position of the Brazilian Supreme Court regarding cases of State’s objective liability for unconstitutional omission, especially administrative omission. The affronts to fundamental rights of citizens by omissions from the public administration were object of several interpretations in the history of the Brazilian Constitutional Court. For this reason, we begin with an analysis of some recent cases and subsequently we focus our study on the theoretical debate about the main theories of civil liability applicable to cases like those analyzed here.en-US
DescriptionEl artículo pretende exhibir un breve panorama acerca de la posición del Supremo Tribunal Federal cuando el tema es responsabilidad objetiva del Estado por omisión inconstitucional, sobre todo omisión administrativa. Las ofensas a los derechos fundamentales de los ciudadanos por conductas omisas de la Administración Pública ha sido objeto de diversas interpretaciones en la historia de la jurisprudencia constitucional brasileña. Por eso empezamos con un análisis de algunos juzgados recientes y posteriormente concentramos nuestro estudio en el debate teórico existente sobre las principales teorías de la responsabilidad civil aplicables en casos como los aquí analizados.es-ES
