| Description | This article sets forth a selection of categories useful for conceptualizing judicial decision-making in the context of the increasing internationalization of justice and new democratic frameworks. On the one hand, this study uses the heuristic significance of the formalism concept (Weber) to assess the dynamics between the State and the Law, with particular emphasis on legal rationality and judicial decisions on Human Rights cases. On the other hand, it analyzes how realism in its contemporary sense, as defined in the Critical Legal Studies (Kennedy), articulates the legal dimension of politics at methodological and conceptual levels in order to understand changes, recent ruptures and questions of legitimacy concerning international law. | Description | En este artículo revisaremos algunas categorías que – a nuestro juicio- resultan útiles para conceptualizar la decisión judicial en el marco de la creciente internacionalización de la justicia y las nuevas dinámicas democráticas. Mostraremos por un lado, la relevancia heurística del concepto de formalismo (Weber) para pensar la dinámica entre Estado y derecho en el análisis de la racionalidad legal y de las decisiones judiciales en temas de derechos humanos. Por otro lado, analizaremos en qué sentido el realismo en su versión contemporánea, los estudios críticos del derecho (Kennedy), nos permiten articular a nivel metodológico y conceptual esta dimensión legal de lo político con otras dimensiones, los cambios y rupturas recientes, las cuestiones de legitimidad respecto al derecho internacional, desde el estudio del rol del juez en una decisión concreta. | es-ES |
