DescriptionThis paper attemps to establish similaritys and differences between advisory opinions under the Mercosur rules and the preliminary rulings of the European Union law. With this aim we make an explanation about the nature and mechanism of both concepts, and then we analyze them comparatively, using regulatory standars, doctrine and jurisprudence link to the topic. In conclusion we express that the legal nature of the advisory opinions in Mercosur is different from the preliminary rulings in the European Union: they differ in their compulsory and binding nature for the judges who have asked it. However, both are similar in their objetives: ensuring the unity of law and the uniformity in their interpretation and application.en-US
DescriptionEste trabajo trata de establecer puntos de contacto y diferencias entre las opiniones consultivas previstas en la normativa del Mercosur y las cuestiones prejudiciales según su regulación por el derecho comunitario europeo. A esos fines hacemos una exposición sobre la naturaleza y mecanismos de funcionamiento de ambos institutos, para luego analizarlas comparativamente, recurriendo en ambos casos a las normas regulatorias, la doctrina y la jurisprudencia vinculada a la temática. Como conclusión, establecemos que la naturaleza jurídica de las opiniones consultivas tal como existen en la normativa mercosureña es distinta a la de las cuestiones prejudiciales de la Unión Europea pues difieren en cuanto a su efecto vinculante y obligatoriedad para los jueces que las hayan pedido. Sin embargo, ambas encuentran similitud en cuanto a sus objetivos: asegurar la unidad del derecho y la uniformidad en cuanto a su interpretación y aplicaciónes-ES
