| Description | El presente trabajo versa sobre la responsabilidad extracontractual del Estado en el derecho argentino. Se comienza por repasar su larga evolución en la jurisprudencia de la Corte Suprema de Justicia de la Nación, que ante la ausencia de normas en la materia, fue modulando sus particularidades y características. Posteriormente, se examinan críticamente las antagónicas regulaciones esbozadas en el Anteproyecto y en el Proyecto de Código Civil y Comercial de la Nación, y las disposiciones de la reciente ley 26.944 de responsabilidad estatal. Finalmente, se examina la regulación legal del tema desde una perspectiva constitucional, en particular, desde tres aspectos básicos: el reparto de competencias en la forma federal de gobierno, la igualdad ante la ley y la inviolabilidad de la propiedad. | es-ES |
