Description	The recently enacted Civil and Commercial Code joined the indigenous community property in its provisions, consistent with what is mandated by the Constitution. This incorporation has caused a real crisis in legal terms referring to the western theory of property rights. By using the theory of Elinor Ostrom, the analysis of this institute yields a variant overcomes ancient historical dichotomies and throws us an interpretive challenge.	en-US
Description	El Código Civil y Comercial recientemente sancionado incorporó a la propiedad comunitaria indígena en su articulado, en consonancia con lo preceptuado por la Constitución Nacional. Esta incorporación ha provocado una auténtica crisis jurídica en cuanto a la teoría occidental referida al derecho de propiedad. Al utilizar la teoría de Elinor Ostrom, el análisis realizado de este instituto arroja una variante superadora de antiguas dicotomías históricas y nos arroja a un desafío interpretativo.	es-ES
