DescriptionThis commentary exposes some of the most important pending aspects of the 2001 constitutional reform to article 2 of the Constitution, as well as the development of the right to political self-determination since then, as a necessary backdrop to analyze the 2024 reform. The general argument is that twenty-three years later, people no longer require the recognition of rights, but rather mechanisms and guarantees to exercise them. To this extent, as long as the secondary laws of the current reform do not point in that direction, and if the current development of the scope of the right to self-determination is not taken as a minimum floor, the reform to article 2 of the Constitution will not have truly compensated for the historical debt of the Mexican State towards indigenous and Afro-descendant peoples and communities.en-US
DescriptionEl presente comentario expone algunos de los pendientes más importantes de la reforma constitucional de 2001 al artículo 2o. constitucional, así como el desarrollo del derecho a la libre determinación política desde entonces, como telón de fondo necesario para analizar la reforma de 2024. El argumento general es que veintitrés años después los pueblos ya no requieren el reconocimiento de derechos, sino mecanismos y garantías para ejercerlos. En esta medida, mientras las leyes secundarias de la actual reforma no apunten en esa dirección, y si no se toma como piso mínimo el desarrollo actual de los alcances del derecho a la libre determinación, la reforma al artículo 2o. constitucional no habrá resarcido realmente la deuda histórica del Estado mexicano hacia los pueblos y comunidades indígenas y afrodescendientes.es-ES
