DescriptionThe phenomenon of informality in Peru is a complex and multifaceted one, reflecting the limitations of the capitalist system in providing decent and survival-enhancing jobs for citizens. The author postulates that the phenomenon of informal activity can be attributed to two fundamental reasons. The first of these reasons relates to unfavourable economic circumstances that force people to act outside the law. The second reason is the intention to deviate from the law in order to increase income in a particular activity. In this context, the social effects of informality include the exclusion of social rights and social segmentation, which serves to highlight the urgency of public policies that address informality as an integral component of society. It is therefore imperative that social law be adapted to guarantee fundamental rights, thereby promoting social inclusion and combating precarious employment. The Constitution must remain the unifying pillar of the legal system, while the State must work to expand the market and formalise the economy, ensuring that all citizens have access to decent and fair living conditions.en-US
DescriptionLa informalidad en el Perú es un fenómeno complejo y multifacético que refleja las limitaciones del sistema capitalista para ofrecer empleos decentes y que permitan la supervivencia de los ciudadanos. El autor sugiere que la actividad informal se encuentra en dos razones fundamentales. La primera se relaciona con las desfavorables circunstancias económicas que obligan a las personas a actuar al margen de la ley. En cambio, en la segunda razón se evidencia la intención de apartarse de la ley para incrementar sus ingresos en determinada actividad. En ese contexto, los efectos sociales de la informalidad abarcan la exclusión de derechos sociales y la segmentación social, lo que evidentemente remarca la urgencia de políticas públicas que aborden la informalidad como un componente integral de la sociedad. Por ello, es imperativo que el Derecho Social se adapte para garantizar los derechos fundamentales, promoviendo la inclusión social y combatiendo la precariedad laboral. La Constitución deberá mantenerse con el pilar unificador del sistema jurídico, mientras que el Estado debe trabajar en la expansión del mercado y formalizar la economía, asegurando que todos los ciudadanos tengan acceso a condiciones de vida dignas y justas.es-ES
