DescriptionThis paper discusses the complex and dynamic relationship between law, science and technology. In this regard, the author identifies three basic models that facilitate the interaction of legal intervention with science and technology. These models can be classified as legislative, judicial and technocratic. As will be seen in the text, each model has a distinctive approach, but they all share the need to adapt to the changes driven by the scientific paradigm. In this context, the importance of creating a "homeostatic" law is emphasised. That is, a law that can adapt to constant change. This law manifests itself in a flexible regulatory framework capable of adapting to the new realities promoted by scientific and technological innovation.en-US
DescriptionEl presente trabajo discute la compleja y dinámica interrelación entre el derecho, la ciencia y la tecnología. En esa medida, el autor identifica tres modelos fundamentales que facilitan la interacción de la intervención jurídica con la ciencia y la técnica. Estos modelos pueden clasificarse en legislativo, judicial y tecnocrático. Como se podrá apreciar en el texto, cada modelo posee un enfoque distintivo, pero todos comparten la necesidad de adaptarse a los cambios impulsados por el paradigma científico. En ese contexto, se subraya la importancia de crear un derecho “homeostático”; es decir, un derecho que pueda acoplarse a los constantes cambios. Este derecho se manifiesta a través de un marco regulatorio flexible y capaz de adecuarse a las nuevas realidades potenciadas por la innovación científica y tecnológica.es-ES
