DescriptionThis article addresses two topics relevant to family law: cohabitation and in vitro fertilization. First, it analyzes concubinage as an ancient social practice resistant to eradication, even in the face of the influence of the Church. Although regulated in certain contexts, it continues to be a widespread phenomenon in several regions of Peru, where it adopts different names and forms. Second, in vitro fertilization, a recent scientific technique that has generated profound moral and legal dilemmas, is examined. In this line, the author highlights how this practice, initially developed in animals, currently raises challenges about filiation and parental rights in complex cases such as frozen embryos or insemination with external donors. In addition, the article highlights the need for law and morality to adapt to these new realities, especially with regard to the regulation of the family and the protection of human life. Finally, it stresses the importance of the State, in conjunction with experts, acting proactively to integrate these social and scientific realities into the legal framework, promoting legislation that respects both traditional customs and the advances of science.en-US
DescriptionEl presente artículo aborda dos temas relevantes para el derecho familiar: el concubinato y la fertilización in vitro. En primer lugar, analiza el concubinato como una práctica social antigua y resistente a la erradicación, incluso frente a la influencia de la Iglesia. Aunque regulado en ciertos contextos, continúa siendo un fenómeno extendido en varias regiones del Perú, donde adopta nombres y formas diferentes. En segundo lugar, se examina la fertilización in vitro, una técnica científica reciente que ha generado dilemas morales y jurídicos profundos. En ese contexto, el autor destaca cómo esta práctica, desarrollada inicialmente en animales, plantea actualmente desafíos sobre la filiación y los derechos parentales en casos complejos como el de embriones congelados o inseminación con donantes externos. Además, el artículo resalta la necesidad de que el derecho y la moral se adapten a estas nuevas realidades, especialmente en lo que respecta a la regulación de la familia y la protección de la vida humana. Finalmente, se subraya la importancia de que el Estado, en conjunto con expertos, actúe proactivamente para integrar estas realidades sociales y científicas al marco legal, promoviendo una legislación que respete tanto las costumbres tradicionales como los avances de la ciencia.es-ES
