DescriptionThe most deeply rooted and difficult to eradicate expression of control and domination is the supremacy that men have historically exercised over women, proving to be a dynamic of unequal power that has endured over time. Consequently, its incidence is observed in the regulation of the Peruvian Civil Code. Given this situation, the paper recognizes that the most significant constitutional reform was to enshrine the equality of all persons before the law, who should enjoy the same rights and have identical obligations. Along these lines, women are no longer considered as subjects with relative incapacity and, in addition, they are granted the right to vote without restrictions. Likewise, the draft Civil Code incorporates a series of favorable reforms to the existing rules of cohabitation that only favored men. However, it’s also pointed out that, although a more equitable approach is promoted legislatively, this doesn’t imply that the Peruvian population is willing to change, and a cultural diffusion of equality between men and women is necessary.en-US
DescriptionLa expresión de control y dominación más profundamente enraizada y difícil de erradicar es la supremacía que históricamente los hombres han ejercido sobre las mujeres, demostrando ser una dinámica de poder desigual que ha perdurado a lo largo del tiempo. En consecuencia, se observa su incidencia en la regulación del Código Civil peruano. Dada esta situación, el trabajo reconoce que la reforma constitucional más significativa fue consagrar la igualdad de todas las personas ante la ley, debiendo gozar de los mismos derechos y tener idénticas obligaciones. En esa línea, la mujer deja de ser considerada como sujeto con incapacidad relativa y, además, se le otorga el derecho al sufragio sin restricciones. Asimismo, el Proyecto del Código Civil incorpora una serie de favorables reformas a las existentes normas de convivencia que sólo favorecían a los hombres. No obstante, también se señala que, aunque legislativamente se promueva un enfoque más equitativo, ello no implica que la población peruana esté dispuesta al cambio, siendo necesaria una difusión cultural sobre la igualdad entre el hombre y la mujer.es-ES
