The objective of this paper is to analyze the functioning of the Judicial Branch in the context of the modifications introduced by the 1979 Peru's Political Constitution. To this end, the constitutional articles relating to the judiciary and its functioning will be examined, emphasizing the main changes with respect to the 1933 Constitution. It also examines how access to justice manifests itself in practice and the real complications. In conclusion, the 1979 Constitution grants more protection by recognizing additional aspects of the Judiciary, reinforcing its structure and functionality. However, more modifications should be considered to achieve its purpose.El objetivo del presente trabajo es analizar el funcionamiento del Poder Judicial en el contexto de las modificaciones introducidas por la Constitución Política del Perú de 1979. Para ello, se examinan los artículos constitucionales relacionados con el Poder Judicial y su operatividad, destacando los cambios más significativos respecto a la Constitución de 1933. Además, se evaluará cómo se manifiesta en la práctica el acceso a la justicia y sus complicaciones reales. En conclusión, la Constitución de 1979 otorga un carácter constitucional más robusto al reconocer aspectos adicionales de la judicatura, fortaleciendo así su estructura y funcionalidad. Sin embargo, se deberán seguir planteando mayores modificaciones para lograr su finalidad.
