DescriptionThis paper aims to explore the right of access to justice in Peru and will focus on developing a new notion of the right of access to justice, taking into account the institutional, social and economic barriers that are presented against. The first part explains the positions on the right of access to justice in the past and raises a new notion to address the issue effectively. The second part develops the institutional barriers such as legal education, the procedural burden, the organization of the Judicial Power and other institutions of justice and their respective budgets. Then, social barriers such as linguistic, cultural and gender are developed. Subsequently, the economic barriers of access to justice are pointed out. Finally, propose measures that could help build an inclusive justice system in order to create a right of access to justice that is effective and real for society.en-US
DescriptionEste trabajo pretende explorar el derecho de acceso a la justicia en el Perú y se concentrará en desarrollar una nueva noción del derecho de acceso a la justicia teniendo en cuenta las barreras institucionales, sociales y económicas que se presentan en contra. La primera parte explica las posturas sobre el derecho de acceso a la justicia en el pasado y plantea una nueva noción para abordar el tema de manera efectiva. La segunda parte desarrolla las barreras institucionales como la educación jurídica, la carga procesal, la organización del Poder Judicial y otras instituciones de justicia y, sus respectivos presupuestos. Luego, se desarrollan las barreras sociales como la lingüística, cultural y de género. Posteriormente, se señalan las barreras económicas del acceso a la justicia. Finalmente, se proponen medidas que podrían ayudar a construir un sistema de justicia inclusivo con el fin de crear un derecho de acceso a la justicia que sea efectivo y real para la sociedad.  es-ES
