This paper aims to study the development of arbitration in Peru, taking into account the foundations that gave rise to its emergence, the legislative advances over time and will focus on analyzing the popular arbitration that has arisen as a result of all the mentioned advances, which has given way to a new popular justice. The first part will make a brief introduction of the different conflict resolution mechanisms and the crisis through which the Peruvian official justice system goes through. After that, the emergence of arbitration in history will be analyzed and how it has been positioned both in Peruvian legislation and in society, making more extensive use. The third part develops the increasing use of arbitration as a means of conflict resolution by the State and the corresponding legislation. After that, the use of arbitration in areas considered popular is emphasized, extending the use of this mechanism of conflict resolution to the majority population together with legislation that supports it. Finally, certain conclusions are offered regarding the benefits of the use of arbitration in its different areas, which are very useful in the face of the increasing work load that the Judicial Power supports.Este trabajo pretende estudiar el desarrollo del arbitraje en el Perú, teniendo en cuenta los fundamentos que dieron base a su surgimiento, los avances legislativos a través del tiempo y se enfocará en analizar el arbitraje popular que ha surgido como consecuencia de todos los avances mencionados, lo cual ha dado pase a una nueva justicia popular. La primera parte realizará una breve introducción de los distintos mecanismos de resolución de conflictos y la crisis por la cual atraviesa la justicia oficial peruana. Luego de ello, se analizará el surgimiento del arbitraje en la historia y cómo ha ido posicionándose tanto en la legislación peruana como en la sociedad, haciendo de uso más extenso. La tercera parte desarrolla el creciente uso del arbitraje como medio de resolución de conflictos por parte del Estado y la legislación correspondiente. Posterior a ello, se enfatiza el uso del arbitraje en ámbitos considerados como populares, extendiéndose el uso de este mecanismo de solución de conflictos hacia la población mayoritaria junto con legislación que la respalda. Finalmente, se brindan ciertas conclusiones respecto de los beneficios del uso del arbitraje en sus distintos ámbitos, los cuales son de mucha utilidad frente a la creciente carga de trabajo que soporta el Poder Judicial y que impide que pueda ejercer una adecuada tutela.
