The material patrimony of the Pontifical Catholic University of Peru is a complex issue since it is questioned how these will be managed and above all who will be the managers. The records indicate that several wills were issued, but there are two relevant wills. The first of these two was in 1933 and the second one in 1938. Recently, the PUCP requested a writ of amparo proceeding due to the violation of their constitutional rights as the right of property and the right of university autonomy. Thus, on March 17, 2010, the Constitutional Court declared the legal protection process unfounded in a judgment that deserves attention given its legal argumentative content. Based on this, the professor Manuel Atienza performs a cross-sectional analysis of the decision of each of the magistrates who issued the judgment. Consequently, this work evaluates the legal argumentation of the sentence handed down by the majority of the judges of the Constitutional Court. First, this article criticizes the competence exercised by the Constitutional Court regarding substantive issues that it could not develop. Second, this article criticizes the handling and use of language used by the TC in which it becomes a partial language. Third, it will analyze the legal foundations that the magistrates used. Especially, it presents a special emphasis on the doctrine about the interpretation of the wills which the TC used in its argumentation. The author presents his thesis in which the application of the proportionality trial in the present case stands out.El patrimonio material de la Pontificia Universidad Católica del Perú constituye un tema complejo dado que se cuestiona cómo estos serán administrados y, sobre todo, quiénes serán los administradores. Los archivos indican que se emitieron varios testamentos; sin embargo, son dos los relevantes: primero, el de 1933, y el segundo, el de 1938. Recientemente, la PUCP interpuso un proceso de amparo, en la búsqueda de protección del agravio de sus derechos constitucionales como el derecho de propiedad y el derecho de autonomía universitaria. Ante esto, el 17 de marzo del 2010, el Tribunal Constitucional declaró infundado el proceso de amparo en una sentencia que merece atención por su contenido argumentativo jurídico. En función a ello, el catedrático Manuel Atienza realiza un análisis trasversal de la decisión de cada uno de los magistrados que expidieron aquella sentencia. En consecuencia, el objeto de estudio del presente artículo es evaluar la argumentación jurídica de la sentencia emitida por la mayoría del TC, referente al caso mencionado. Por ello, primero se hace una crítica sobre la competencia que ejerce el Tribunal Constitucional respecto a las cuestiones de fondo que no le pertenecen desarrollar. Segundo, se critica también el manejo y uso de lenguaje que utiliza el TC, en la que deviene a ser incluso un lenguaje parcializado. Tercero, se analiza los fundamentos de derecho que los magistrados utilizaron. En especial, se hace énfasis en la doctrina sobre la interpretación de los testamentos que utilizó el TC en su argumentación. Finalmente, el autor expone su tesis en la cual resalta el juicio de ponderación que debió aplicarse en la sentencia mencionada.
