The purpose of this article is to contribute to the discussion of the legal arguments contained in the sentence issued by the Constitutional Court. The topic discussed was the constitutional protection filed by the Pontificia Universidad Católica del Peru against the judgment of the Eighth Civil Chamber of the Superior Court of Justice of Lima, which was declared unfounded. The debate focuses on how the decision of the majority of the magistrates has been. For this reason, the author will carry out an analysis from the argumentative approach in which he demonstrates why he finds it unjustified and arbitrary. In this line, first of all, he presents what are the problems of the sentence, identifying its argumentative fallacies. Then, he goes on to assess in detail the competence of the TC when it ruled on the matter of the interpretation of will provisions and did not consider the constitutional arguments raised by the PUCP. Secondly, the author emphasizes the need for adequate argumentation within the framework of a Constitutional State of Law. In this way, he emphasizes that any legal act, whether public or private, must be compatible with the constitutional framework. Third, he analyzes the pragmatic dimension of the legal argumentation of the aforementioned sentence, thus referring to the rhetorical resources used by the majority vote of the magistrates of the TC. In short, throughout the article the argumentative problems of the TC ruling are elucidated.El objeto del presente artículo es contribuir con la discusión de la argumentación jurídica contenida en la sentencia expedida por el Tribunal Constitucional. El tema tratado fue en torno al amparo constitucional que interpuso la Pontificia Universidad Católica del Perú contra la sentencia de la Octava Sala Civil de la Corte Superior de Justicia de Lima, la cual fue declarada infundada. El debate se centra en cómo ha sido la decisión de la mayoría de los magistrados. Por ello mismo, el autor realizará un análisis desde el enfoque argumentativo en el que demuestra porqué lo encuentra injustificada y arbitraria. En esta línea, en primer lugar, se presenta cuáles son los problemas de la sentencia, identificando las falacias argumentativas de la misma. Luego, pasa a evaluar con detalle la competencia del TC cuando este se pronunció respecto a la materia de la interpretación de las disposiciones testamentarias y no consideró los argumentos constitucionales que planteó la PUCP. En segundo lugar, el autor hace énfasis en resaltar la necesidad de una adecuada argumentación en el marco de una Estado Constitucional de Derecho. De esta manera, se resalta que cualquier acto jurídico, ya sea público o privado, debe ser compatible con el marco constitucional. En tercer lugar, se analiza la dimensión pragmática de la argumentación jurídica de la mencionada sentencia, refiriéndose así a los recursos retóricos empleados por el voto mayoritario de los magistrados del TC. En suma, a lo largo del artículo se dilucidan cuáles han sido los problemas de argumentativos de la sentencia del TC.
