Uno de las principales aprehensiones que ha generado la implementación de tribunales civiles online, es la situación en la que quedan frente a ellos las personas que no tienen acceso a internet. Por ello en este trabajo proponemos una fórmula para introducir dicho mecanismo de solución de controversias, sin afectar el derecho a la tutela judicial efectiva de aquellas personas que no tienen acceso a la web. En buenas cuentas lo que pretendemos es encontrar el equilibrio entre esta política que ya ha demostrado su valor en términos de ahorrar tiempo y costos de litigación, y la obligación del Estado de garantizar a todos sus habitantes el derecho a acceder a los tribunales de justicia.One of the main concerns associated to the implementation of online civil courts is the situation of those persons that do not have access to the internet. In that sense, in this work we propose a formula to introduce such courts without affecting the right to access to justice of those that do not have access to the web. The idea is to find the adequate balance between this policy that have already proven its value in saving litigation time and costs, and the State’s duty to secure the right to access the courts of justice to all its citizens.
