DescriptionThe text analyzes the concept of natural law, which is based on universal principles that guide human conduct towards the “good”, independently of the provisions of positive law. The author points out that natural law is not a human creation, but a reality discovered in the very essence of the human being, which manifests itself through practical judgments that allow discerning between what is right to be done and what should be avoided. He argues that law transcends epochs and cultures, being inherent to human nature, which is reflected in norms that prohibit murder, theft or deceit. To that extent, it is emphasized that these “duties” are a requirement that emanates from the personal being. Likewise, unlike positive laws, natural law responds to immutable principles and does not depend on human codifications, but on the rationality of human beings. However, its application may vary according to historical or cultural circumstances, as occurred with slavery. In this regard, the author argues that the historical existence of slavery does not contradict the fundamental principles of this law, since this practice can be classified as a fourth-class precept within the hierarchy of natural law. In essence, this law connects the intrinsic morality of man with universal values, establishing an ethical order superior to human laws.en-US
DescriptionEl texto analiza el concepto de ley natural, el cual se fundamenta en principios universales que orientan la conducta human hacia el “bien”, independientemente de las disposiciones del derecho positivo. El autor señala que la ley natural no es una creación humana, sino una realidad descubierta en la esencia misma del ser humano, que se manifiesta a través de juicios prácticos que permiten discernir entre lo que es correcto realizarse y lo que debe evitarse. Sostiene que la ley trasciende épocas y culturas, siendo inherente a la naturaleza humana, que se ve reflejada en normas que prohíben el asesinato, robo o engaño. En esa medida, se enfatiza que estos “deberes” son una exigencia que emana del ser personal. Asimismo, a diferencia de las leyes positivas, la ley natural responde a principios inmutables y no depende de codificaciones humanas, sino de la racionalidad propia del ser humano. Sin embargo, su aplicación puede variar según las circunstancias históricas o culturales, tal como ocurrió con la esclavitud. Sobre ello, el autor plantea que la existencia histórica de la esclavitud no contradice los principios fundamentales de esta ley, ya que dicha práctica puede clasificarse como un precepto de cuarta clase dentro de la jerarquía de la ley natural. En esencia, esta ley conecta la moralidad intrínseca del hombre con valores universales, estableciendo un orden ético superior a las leyes humanas.es-ES
