DescriptionIn order to conduct an analysis of the legal changes occurring in a specific country, it is imperative to approach the study autonomously and detached from external influences. However, in certain circumstances, it is pertinent to incorporate an observation of social and economic phenomena to obtain a more complete understanding and a more precise explanation of the legal phenomena that arise in the legal environment. The main objective of this paper is to examine the transformations that have taken place in the Peruvian legal system in the years before 1973. In this context, it proposes an exhaustive analysis of both the conceptual bases that sustain the traditional legal ideology and the socio-legal dynamics that arose because of the agrarian reform in Peru. The aim is to show how the reform has had an impact on these conceptual bases. By means of this analysis, the conclusion is reached that an adequate conceptualization of law necessarily requires reflecting the surrounding reality, without seeking to distance from it. en-US
DescriptionPara realizar un análisis de los cambios jurídicos que acontecen en un país específico, resulta imperativo abordar el estudio de manera autónoma y desligada de influencias externas. No obstante, en determinadas circunstancias, resulta pertinente incorporar una observación de los fenómenos sociales y económicos, con el fin de obtener una comprensión más completa y una explicación más precisa de los fenómenos jurídicos que surgen en el entorno del derecho. El presente trabajo tiene como objetivo principal examinar las transformaciones que han tenido lugar en el sistema jurídico peruano en los años previos a 1973. En este contexto, se propone un análisis exhaustivo tanto de las bases conceptuales que sustentan la ideología jurídica tradicional como de la dinámica socio-jurídica surgida a raíz de la reforma agraria en el Perú. Se pretende así evidenciar cómo esta última ha impactado en dichos fundamentos conceptuales. A través de este análisis, se llega a la conclusión de que una adecuada conceptualización del derecho requiere necesariamente reflejar la realidad circundante, sin buscar distanciarse de ella.es-ES
