This article develops in detail the central aspects of international maritime sales. Through an exhaustive analysis, the author addresses the differences between FOB and CIF commercial terms, highlighting the need to develop clear stipulations in order to avoid interpretative disputes and litigation. This refers to central aspects such as delivery of goods, place, date, costs, risks, time of payment and transfer of risks and liability. Along these lines, the author points out that, in a sale and purchase on FOB terms, the seller fulfills its obligations by making the free delivery of the goods, without getting involved in the transport and maritime insurance, the costs of which are borne by the buyer. On the other hand, in a sale and purchase on CIF terms, the seller assumes additional responsibilities, including transportation and insurance to the agreed point of destination. In this regard, in addition to highlighting the importance of the precision of central elements, the legal and financial implications of the contractual clauses in the context of containerized transport are examined. Based on the above, the author emphasizes the need for absolute precision in the drafting of maritime contracts in order to avoid conflicts and ensure a smooth execution of commercial operations.El presente artículo desarrolla de manera detallada los aspectos centrales de los contratos de compraventa en el ámbito marítimo internacional. A través de un análisis exhaustivo, el autor aborda las diferencias entre los términos comerciales FOB y CIF, destacando la necesidad de elaborar estipulaciones claras para evitar disputas interpretativas y litigios. Ello en lo referido a aspectos centrales como la entrega de mercancías, lugar, fecha, costos, riesgos, momento de pago y transferencia de riesgos y responsabilidad. En esa línea, el autor señala que, en una compraventa en términos FOB, el vendedor cumple con sus obligaciones al realizar la entrega franca de las mercancías, sin involucrarse en el transporte y seguro marítimo, cuyos costos recaen en el comprador. En cambio, en una compraventa en términos CIF, el vendedor asume responsabilidades adicionales, incluyendo el transporte y seguro hasta el punto de destino convenido. Sobre ello, además de destacar la importancia de la precisión de elementos clave, se examina las implicancias legales y financieras de las cláusulas contractuales en el marco de transporte de contenedores. Partiendo de lo expuesto, el autor enfatiza la necesidad de una precisión absoluta en la redacción de los contratos marítimos con el fin de evitar conflictos y garantizar una ejecución fluida de las operaciones comerciales.
