DescriptionThis article addresses the relationship between legal interpretation and the political dimension inherent in judicial activity, arguing that law presents an "open texture" that allows judges to choose among various alternatives. In this regard, the author points out that the law cannot be applied mechanically, since legal norms have various possible meanings and offer multiple interpretations. In line with this, he alludes to Wittgenstein's thesis on the indeterminacy of words and the necessity of interpreting the rules themselves, and emphasizes that judicial activity does not lead to an apolitical, but to an unconscious politics, which highlights the importance of a personal political reflection by judges and lawyers. Therefore, he emphasizes the need for well-founded and published rulings, as well as the possibility of introducing mass action judicial procedures, while there is an absence of explicit definitions in the laws that grant a significant margin of discretion to judges, which highlights the non-mechanical and political nature of judicial interpretation. Finally, the author argues for the existence of a modernly equipped judiciary that supports its own independent political reflection.en-US
DescriptionEl presente artículo aborda la relación entre la interpretación del derecho y la dimensión política inherente a la actividad judicial, argumentando que el derecho presente una "textura abierta" que permite al juez optar entre diversas alternativas. Al respecto, el autor señala que el derecho no puede ser aplicado mecánicamente, ya que las normas jurídicas tienen diversos significados posibles y ofrecen varios sentidos abiertos a la interpretación. En esa línea, alude a la tesis de Wittgenstein sobre la indefinición de las palabras y la necesidad de interpretar las reglas mismas, y destaca que la actividad judicial no conduce a una apoliticidad, sino a una política inconsciente, lo que resalta la importancia de una reflexión política personal por parte de los jueces y abogados. De ello que enfatiza la necesidad de resoluciones fundamentadas y publicadas, así como la posibilidad de introducir procedimientos judiciales de acción masiva, en tanto existe una ausencia de definiciones explícitas en las leyes que otorgan un margen de discreción significativo a los jueces, lo que resalta la naturaleza no mecánica y política de la interpretación judicial. Para finalizar, el autor aboga por la existencia de un Poder Judicial modernamente equipado que respalde una reflexión política propia e independiente.es-ES
