This work reviews all the judgments handed down by the CJEU as a consequence of the preliminary rulings raised by different national courts on the determination of international judicial jurisdiction in matters of passenger air transport contracts. The claims based on the compensation established in Regulation 264/2001 and the compensation of the Montreal Convention have forced the CJEU to interpret the interaction between both regulations and, above all, the term place of fulfillment of the provision of art.7.1a) of the Brussels I-bis Regulation since the seminal Rehder ruling. The CJUE, in its decisions, has gradually brought the level of protection of the consumer of air passengers closer to the general regime of arts. 17-19 of the Brussels I-bis Regulation, achieving that in many cases the forum actoris of the claimant passenger is a de facto reality. Starting from the fact that there is still a long way to go for the equality between both consumers, it would be necessary to conclude that the function of the CJEU through its jurisprudence will also be essential in the future so that the right to effective judicial protection has the same content in both categories of consumers at least within the European Union. Este trabajo da un repaso a todas las sentencias dictadas por el TJUE como consecuencia de las cuestiones prejudiciales planteadas por diferentes tribunales nacionales sobre la determinación de la competencia judicial internacional en materia de contratos de transporte aéreo de pasajeros. Las reclamaciones en base a las compensaciones establecidas en el Reglamento 264/2001 y a las indemnizaciones del Convenio de Montreal han obligado al TJUE a interpretar la interacción entre ambas normas y sobre todo el término lugar de cumplimiento de la prestación del artículo 7.1a) del Reglamento Bruselas I-bis desde la seminal sentencia Rehder. El TJUE, en sus decisiones ha ido acercando el nivel de protección del consumidor pasajero de avión al régimen general de los arts. 17-19 del Reglamento Bruselas Ibis, consiguiendo que en muchos casos el forum actoris del pasajero demandante sea una realidad de facto. Partiendo de que queda un largo camino por recorrer para la equiparación entre ambos consumidores, habría que concluir que la función del TJUE a través de su jurisprudencia será fundamental también en el futuro para que el derecho a la tutela judicial efectiva tenga el mismo contenido en ambas categorías de consumidores al menos en el ámbito de la Unión Europea.
