DescriptionThe analysis of European supranational sources, the European Union and the Council of Europe, shows that the concept of animal is articulated on a plurality of legal categories that require the need to use the plural: there is no "animal", as unitary and compact category, but rather "animals", each with its own specific characteristics, recipients from time to time, of particular disciplines and protections. Over time we can see the emergence of awareness, borrowed from the increase in scientific knowledge, of the ability of some animals to feel pleasure, pain, fear, anguish, etcetera characteristics that make them "sentient beings" and require a growth of attention and protection. The overall picture, however, is still sometimes ambiguous and in any case in progressive evolution. The European Union has planned to prepare a new and coordinated discipline on the subject by the end of 2023.en-US
DescriptionL’analisi delle fonti sovranazionali europee, Unione europea e Consiglio d’Europa, mostra che il concetto di animale viene articolato su una pluralità di categorie giuridiche che richiedono di necessità di ricorrere al plurale: non esiste “l’animale”, come categoria unitaria e compatta, bensì “gli animali”, ognuno con sue specifiche caratteristiche, destinatari di volta in volta, di peculiari discipline e tutele. Nel corso del tempo si ravvisa l’emergere della consapevolezza, mutuata dall’incremento delle conoscenze scientifiche, della capacità di alcuni animali di provare piacere, dolore, paura, angoscia, eccetera, caratteristiche che ne fanno “esseri senzienti” e richiedono una crescita di attenzione e di tutela. Il quadro complessivo, tuttavia, risulta ancora talora ambiguo e comunque in progressiva evoluzione. L’Unione europea ha previsto di predisporre una nuova e coordinata disciplina della materia entro la fine del 2023.it-IT
