DescriptionThis chapter analyzes the case law issued by the Human Rights Committee and the Inter-American Court on issues associated with sexual diversity. In particular, cases related to sexual orientation and gender identity that have been known to both international bodies were examined. It is concluded that although the case law criteria expressed in the respective cases represent an important formal advance regarding the recognition of human rights —as the cases themselves are referents that generate relative judicial and symbolic transformations— they certainly increase the challenges for the generation of transformative social changes for groups of sexual diversity, who continue to bear multiple discriminations in daily practice.en-US
DescriptionEl artículo analiza la jurisprudencia emitida por el Comité de Derechos Humanos y la Corte IDH en temáticas asociadas con la diversidad sexual. Particularmente, se efectúa un examen de los casos relacionados con la orientación sexual y la identidad de género que han sido de conocimiento de ambas instancias internacionales. Se concluye que, si bien los criterios jurisprudenciales —expresados en los respectivos casos— representan un avance formal importante en materia de reconocimiento de los derechos humanos, porque los propios casos son referentes que generan relativas transformaciones judiciales y simbólicas, ciertamente aumentan los desafíos de cara a generar cambios sociales trasformadores para los grupos de la diversidad sexual, quienes continúan soportando múltiples discriminaciones en la práctica cotidiana.es-ES
