DescriptionThis article reviews the ideas and initiatives of the politician and legal expert Mariano Otero regarding the imprisonment reform proposed and partially developed during the XIX century. Otero, well known by his contributions to constitutional matter and about amparo proceedings (consider the so called “Otero formula”, incorporated in 1847), has not been as recognized regarding his studies and proposals in criminal and imprisonment matters. This famous liberal from the state of Jalisco had a clear consciousness of the relevance of criminal legislation within the tasks of the State and of the need of — always present— renewing the imprisonment system and fostering a good treatment for the inmates. He had the influence of treatise writers and reformers of the XVIII century, such as Jeremias Bentham and John Howard. In his conceptualization, it was necessary to adopt the so called “Philadelphia” system, which called the attention worldwide and attracted new European visitors, as Tocqueville and Beaumont, who wished to know the advance made in the United States imprisonment centers.en-US
DescriptionEste artículo revisa las ideas e iniciativas del político y jurista Mariano Otero en relación con la reforma penitenciaria planteada y parcialmente desenvuelta en el siglo XIX. Otero, bien conocido por sus aportaciones en materia constitucional y en torno al juicio de amparo (recuérdese la llamada “fórmula Otero”, incorporada en 1847), lo ha sido menos en lo que respecta a sus estudios y propuestas en materia penal y penitenciaria. El ilustre liberal jalisciense tuvo clara conciencia de la relevancia de la legislación penal dentro de las tareas del Estado y de la necesidad —siempre vigente— de renovar el sistema de prisiones y alentar el buen trato a los reclusos. Recibió la influencia de tratadistas y reformadores del siglo XVIII, como Jeremías Bentham y John Howard. En su concepto, era necesario adoptar el llamado sistema “filadélfico”, que llamó la atención en el mundo entero y atrajo a visitantes europeos, como Tocqueville y Beaumont, que deseaban conocer los avances alcanzados en los reclusorios norteamericanos.es-ES
