This work aims to problematize and trace the shape of the operational differentiation of the political system and system of law in Mexico. Specifically, analyze performance and structural links between the two systems and the conditions of possibility for its operation, which involves installing the problem not only in the logic of progress and historical development, especially in the evolutionary process of generation and construction both the social order as expectations that guide and reproduce. Moreover, confronting these forms of structuring the budgets to understand modern society as a distinct society functions.Este trabajo se orienta a problematizar y rastrear la forma de la diferenciación operativa del sistema político y del sistema del derecho en México. Específicamente, se analizan los acoplamientos y prestaciones estructurales entre ambos sistemas, así como las condiciones de posibilidad para su operación, lo cual implica instalar el problema no sólo en la lógica del progreso y desarrollo histórico, sino también en el del proceso evolutivo de la generación y construcción tanto del orden social como de las expectativas que lo orientan y reproducen. Además, se confrontan estas formas de estructuración con los presupuestos de entender la sociedad moderna como sociedad diferenciada por funciones.
