DescriptionSince the entry into force of the North American Free Trade Agreement, it has been summited around one hundred and twenty seven times before the ad hoc arbitration tribunal regulated by article 1904, which thirteen of them were objections against the ruling of the mexican´s authority on this matter “Unidad de Prácticas Comerciales Internacionales”. In this context, the current research highlights the main arguments of the abovementioned cases, with some comments of trade experts and authors, in order to analyze the possibility to address an undoubtedly noteworthy evolution of criteria within the mexican’s practice law.en-US
DescriptionDesde la entrada en vigor del Tratado de Libre Comercio para América del Norte se ha acudido aproximadamente ciento veintisiete veces al procedimiento de revisión de tribunales arbitrales ad hoc previsto en su artículo 1904, de las cuales trece han sido resueltos mediante una decisión final emitida por la autoridad mexicana competente en esta materia, denominada “Unidad de Prácticas Comerciales Internacionales”. Bajo este contexto, la presente investigación resalta las principales argumentaciones de estos trece casos, acompañados de algunos comentarios de expertos y tratadistas, con objeto de analizar si se ha presentado una evolución de criterios digna de resaltarse dentro de la práctica jurídica mexicana.es-ES
