DescriptionThe slogan “an animal is not a gift” seems quite obvious nowadays. However, the obviousness of this claim is not accompanied by a change in social practices, including the law. Indeed, the law does not prohibit the donation of an animal as a gift – animals can therefore be the ‘object’ of a donation contract. This leads to a number of legal and ethical challenges: with the acceptance of the ‘gift’ the recipient becomes responsible before the law for the animal’s fate. In turn, the giving of a gift is not necessarily accompanied by an explicit ‘acceptance of responsibility for the gift’ – traditionally, the giving of gifts is not associated with ‘responsibility’ but pleasure of recipient. The paper aims to present and evaluate the legal and ethical challenges of treating animals as a gift (as the object of a donation contract). To this end, the authors present key challenges posed by the application of contract law in such situations, specifically the donation contract, and then juxtapose the legal findings with an ethical view of the status of animals and their relationship to humans according to care ethics approach.en-US
DescriptionEl eslogan «un animal no es un regalo» parece bastante obvio hoy en día. Sin embargo, la obviedad de esta afirmación no va acompañada de un cambio en las prácticas sociales, incluida la legislación. De hecho, la ley no prohíbe la donación de un animal como regalo, por lo que los animales pueden ser «objeto» de un contrato de donación. Esto plantea una serie de retos jurídicos y éticos: con la aceptación del «regalo», el receptor se convierte en responsable ante la ley del destino del animal. A su vez, la entrega de un regalo no va necesariamente acompañada de una «aceptación de responsabilidad por el regalo» explícita: tradicionalmente, la entrega de regalos no se asocia a la «responsabilidad », sino al placer del receptor. El objetivo de este artículo es presentar y evaluar los retos jurídicos y éticos de tratar a los animales como un regalo (como objeto de un contrato de donación). Para ello, los autores presentan los principales retos que plantea la aplicación del Derecho contractual en este tipo de situaciones, concretamente el contrato de donación, y a continuación yuxtaponen las conclusiones jurídicas con una visión ética del estatus de los animales y su relación con los seres humanos según el enfoque de la ética del cuidado.es-ES
